Learning outcomes
PLO 1. Demonstrate knowledge of different legal systems, understand the reasons for their multiplicity, as well as mechanisms of interaction; knowledge of the international legal system characteristics and the place of international law in it. PLO 3. To make reasonable decisions in the law-making and law-enforcement fields of law, realizing their ethical consequences for different subjects of national and international commercial law. PLO 4. Demonstrate the ability to conduct cases in international judicial institutions and other general and special international institutions for the settlement of international disputes, protecting interests of the state, individuals and legal entities. PLO 5. Demonstrate the ability to represent the client's interests in civil and commercial matters in the courts of Ukraine, arbitration courts, state bodies authorized to conduct commercial investigations.
Form of study
Prerequisites and co-requisites
knowledge of the basics of the theory of international investment law and international investment arbitration, their principles and sources; • ability to analyze and establish the content of the rights and obligations of subjects of international law and private international law in accordance with the provisions of domestic law, international treaties and international customs; suggest ways to resolve investment disputes; • possession of basic skills of legal analysis and synthesis, critical thinking, elaboration of a significant array of legal material with the provision of their own conclusions and suggestions.
Course content
The discipline "Resolution of Investment Disputes" is one of the mandatory disciplines for students majoring in "International Law" at the educational qualification level "Master" of the educational program "International Private Law" and aims to acquaint students with the historical stages of development and formation of international investment arbitration , features of sources and basic principles and standards of international investment arbitration, students thoroughly study the main provisions of the Convention on the Settlement of Investment Disputes between States and Foreign Persons of 1965, institutions and rules for resolving investment disputes, basic provisions of bilateral investment agreements and regional investment agreements; works closely with disciplines such as International Civil Procedure, International Commercial Arbitration and is involved in the study of a number of other disciplines, including elective components of the educational program.

Lectures, seminars, solving practical cases, the execution of self-study tasks; performing group tasks-simulations
Assessment methods and criteria
The discipline "Investment Dispute Resolution" is evaluated by a modular rating system. Current control: evaluation of work in seminars and practical classes; performing independent work; students write modular tests. Content module 1 "Fundamentals of the theory of international investment arbitration" (MR1) includes topics 1-5, and content module 2 "Current issues of international investment arbitration" (MR2) - topics 6-7; each of the modules ends with a modular test. The form of final control in the discipline "Resolution of investment disputes" is an exam. Lecture questions, questions of seminar (practical) classes, independent work are taken out on examination. The results of students' educational activity are evaluated on a 100 - point scale: 60 points - work during the semester; 40 points - exam.
