Tasks of the discipline are aimed at forming the following competencies in students: to present their research on current issues of procedural law and protection of intellectual property rights, using primary sources and techniques of legal interpretation of complex problems arising from this study, to substantiate conclusions; know the concepts and legal principles of protection of intellectual property rights; the procedure for protection of intellectual property rights to objects of copyright and related rights, industrial property rights and certain non-traditional intellectual property; features of protection of intellectual property rights in court and administrative proceedings, the use of alternative dispute resolution; be able to correctly interpret the content of national and international legislation on the protection of intellectual property rights.

External form

Prerequisites for mastering the discipline: 1. Know the basic conceptual approaches, theoretical and practical principles of procedural law; main aspects of formation and development of the institute of protection of intellectual property rights; literature sources on the problems of legal protection of intellectual property rights, acts of legislation governing the relations of participants in the field of protection of intellectual property rights. 2. Be able to assess and determine the role and objectives of protection of intellectual property rights. 3. Have basic skills in drafting legal documents, taking into account the peculiarities of the practical situation and with the help of legal methods to resolve disputes arising in the field of disposal of intellectual property rights.

The discipline "Current issues of procedural law. Protection of intellectual property rights" is part of professional training of specialists at Master in Law program, educational course "Intellectual Property" at the Education and Research Law School of Taras Shevchenko National University of Kyiv. The main components of the discipline are aimed at providing students with knowledge about the main problems of procedural law and the principles of legal regulation of relations in the field of using the results of intellectual creative activity; grounds for acquiring legal protection by objects of intellectual property rights; mechanism for the protection of intellectual property rights, the formation of their ability to correctly interpret the content of national and international law on the acquisition, disposal and protection of intellectual property rights.

The study of the discipline involves lectures and practical classes; express survey/testing/essay (abstract) on the proposed topic; modular test work; student self-study in preparation for seminars; credit.

Types of ongoing performance evaluation can be: express survey, report, research, testing (from the set of judgments to choose the right ones), case solving (tasks), module-on control work (final test work). During the ongoing performance evaluation at seminars, the following are assessed: the level of knowledge demonstrated by the student in the answer, activeness in discussing the issues of the seminar, regular work in the classroom, the results of self-study. The discipline is taught during one term. 10 days before the beginning of the session, the teacher who conducts the seminars no longer accepts missing assignments. For students who have not scored the minimum threshold level of assessment, a final test is conducted.
