The objectives of the discipline are aimed at forming the following competencies: gaining the ability to reproduce the deep knowledge within the specialization regarding the safeguarding and protection of rights with the designation of innovations and their modernization in relation to the realities of information and communication technologies, as well as demonstrate the ability to study further in this area of knowledge with a high level of the autonomy.

External form

Prerequisites for mastering the discipline: 1. To know the basic provisions on the protection of civil rights; main provisions of the branches of procedural law of Ukraine and WIPO's authorized providers for resolving domain disputes; the system of sources of intellectual property rights of Ukraine and the main provisions of the laws of Ukraine governing relations in the field of the safeguard and protection of the rights to the results of intellectual and creative activity. 2. To be able to give the legal assessment of the actual situation, to qualify the violations of subjective intellectual property rights, property rights, personal non-property rights, to choose ways of safeguard, forms and methods of protection of subjective rights. 3. To have basic skills in working with a personal computer, information and legal databases, the search and systematization of legal information, Internet search, office work and business communication, preparation of legal documents drafts.

The "Protection of Rights in the IT Industry" discipline is a part of the specialists’ professional training cycle of educational level "Master" in "Law", the "Intellectual Property" educational program at the Education and Research Law School of Taras Shevchenko National University of Kyiv. The main components of the discipline are the provisions on protection and safeguard of intellectual property rights, personal non-property rights in the IT industry, an institutional system of the Internet governance, the legal regime of domain names and websites, e-commerce in the acquisition and management of intellectual property rights, protection of rights to intellectual property objects that are hosted on the Internet.

The study of the discipline includes lectures, seminars; polls (an express survey)/testing/an essay (reference paper) on the proposed topic; module tests; self-study, individual assignments; credit (exam).

Types of ongoing performance evaluation include: express survey, report, scientific paper, testing (multiple choice tests), case solving (tasks), module test (final test). Things to be assessed in the process of ongoing performance evaluation are: the level of knowledge demonstrated by the student during seminars, the level of activity in discussing the issues of the seminar, systematic work in the classroom, self-study and individual assignments results. The discipline is taught during one term. 10 days before the beginning of the session, the teacher conducting the seminars no longer accepts missing assignments. Students who have not scored the minimum threshold level of assessment are given a final test.

Ukrainian
