Learning outcomes
To know the history of the institution of jurisdictional immunities of States, personal immunities of heads of State and other senior State officials. To know the peculiarities of regulating the issues of jurisdictional immunity of State and personal immunities of senior State officials in international legal acts, their subject-matter, territorial, personal and temporal spheres of application. To understand the essence and principles of functioning of the basic limitations on the jurisdictional immunity of State in international law. To understand the implementation of the principles of immunity of heads of State and senior officials in international criminal proceedings. Be able to prepare arguments in cases concerning the official immunities of heads of State and senior State officials, including in international criminal proceedings.
Form of study
Prerequisites and co-requisites
1. Knowledge of the Fundamental Theory of Public International Law, the Fundamentals of International Diplomatic Law; Law of International Responsibility; Comparative Constitutional Law; Comparative Criminal Law and Process; Comparative Administrative Law; the Fundamentals of Judicial Systems. 2. Ability to analyse and establish the content of the rights and obligations of subjects of international law, to apply the rules and principles of international law and the decisions of international courts to meet specific objectives, analyse and establish the content of Ukrainian and foreign legislation. 3. Have the basic skills of legal analysis and synthesis, critical thinking, working out of a considerable amount of legal material while providing one’s own conclusions and proposals.
Course content
Thematic plan of the discipline: 1. Concept and types of immunities. 2. Understanding of jurisdictional immunity in contemporary international law. 3. National legislation on jurisdictional immunities of foreign States. 4. Basic limitations of the jurisdictional immunity of a State in contemporary international law. 5. Role of international jurisprudence in the formation and application of the principle of jurisdictional immunity of States. 6. General principles of immunity of heads of State and officials in international law. 7. Peculiarities of immunities of Heads of State. 8. Peculiarities of immunities of officials (heads of Government, ministers for foreign affairs and other high-ranking representatives of the State). 9. International criminal accountability of heads of State and other high-level representatives of States.

Assessment methods and criteria
Evaluation is carried out according to the modular rating system. Current control: answers (up to 20 points), written assignment (up to 20 points), final modular test (up to 20 points). The form of final control is an exam. The exam is conducted in writing. The student's answer to the exam is up to 40 points.
